Everything about decennial insurance

What is decennial insurance?

Decennial damage insurance covers, for ten years, material damage to the building caused by defects affecting the foundations, load-bearing elements, beams, floor slabs, load-bearing walls or other structural elements that compromise the building's mechanical resistance and stability.

Is decennial insurance mandatory?

Yes. Spain's Building Regulation Act (Ley 38/1999, LOE) requires decennial damage insurance for residential buildings. The developer takes out the policy, and it is a requirement to register the new building in the Land Registry.

What does it cover and for how long?

It covers damage affecting the structural stability and soundness of the building for a period of ten years from the completion (handover) of the works.

Who has to take it out?

The developer or self-promoter of the building. At Seguróx we handle the policy for developers, construction companies and private individuals building their own home.

What is the Technical Control Body (OCT) and why is it required?

The OCT is an independent body that supervises the execution of the works and issues control reports. Insurers require its involvement to issue decennial insurance, as it assesses and helps reduce structural risk.

How is it different from Contractor's All Risks (CAR)?

Contractor's All Risks protects the works against material damage during construction; decennial insurance covers structural damage during the ten years after completion. They are complementary covers.

How much does decennial insurance cost?

The price depends on the material execution budget (PEM), the type of building, its location and the outcome of the technical control. At Seguróx we prepare a tailored, no-obligation study.

Does a self-promoter building a home for their own use need decennial insurance?

Spain's LOE exempts an individual self-promoter building a single-family home for their own use. However, if they sell it within ten years of the handover of the works, they must take out the insurance for the remaining period, unless the buyer expressly waives that obligation.

When should decennial insurance be arranged?

The policy is issued when the works are completed, at handover, but the process starts earlier: the insurer requires a Technical Control Body (OCT) to oversee the works from the design stage or the start of construction. That is why it is best to request a study before work begins.

Can it be arranged once construction has already started?

In many cases yes, although it is harder: the OCT must be able to check what has already been built, such as the foundations and structure, which may require additional documentation or tests, and acceptance depends on the insurer. The earlier it is raised, the more options there are.

Do renovations require decennial insurance?

They may: the LOE also requires it for extension, alteration or renovation works on residential buildings that change their architectural configuration, for example when they affect the structure. Each case must be assessed; we can help you check whether your project requires it.

Who is the insured under decennial insurance?

Until the building has been handed over, the insured is the developer, who is usually also the policyholder and the one who pays the premium. After handover, the insured are the buyers: the first and every subsequent one, because the cover passes with the home on each sale for the time remaining until ten years have elapsed since handover of the works. The contractor may also appear as policyholder on behalf of the developer. More in the guide.

Can decennial insurance be activated in phases or block by block?

Yes. In a development built in phases or block by block, partial entries into cover can be issued for completed homes, provided that their handover certificate and final completion certificate are available. As many partial entries into cover can be issued as there are final completion certificates, and each phase begins its ten years of cover on the date of its own handover certificate. Can decennial insurance be taken out even if it is not mandatory?

Yes. Even when the works do not require it, for example a self-promoter’s home for their own use, decennial insurance can be taken out voluntarily. It gives a future buyer an additional guarantee, as it ensures the repair of any structural damage that appears during the ten years following handover, and avoids problems if the home is sold before that period ends. When is the decennial insurance premium paid?

It is a single premium covering the ten years. If the insurance is taken out at the start of the works, it is paid in two instalments: a premium on account when the pre-policy is formalised, which is a percentage of the premium set by each insurer, and the rest when the entry-into-force endorsement is issued, after handover of the works. If it is taken out once the works are finished, a single payment is made. More in the guide.
